These terms and conditions outline the rules and regulations for the use of Puregold Price Club's mobile app, PUREGOLD MOBILE
By accessing this website we assume that you accept these terms and conditions. Do not continue to use PUREGOLD MOBILE if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this mobile app and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Republic of the Philippines. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
User Rights and Responsibilities
Unless otherwise stated, Puregold Price Club and/or its licensors own the intellectual property rights for all material used in Puregold Online Grocery App – PUREGOLD MOBILE. All intellectual property rights are reserved. You may access this from Puregold Online Grocery App – PUREGOLD MOBILE for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
- Republish material from PUREGOLD MOBILE App
- Sell, rent or sub-license material from PUREGOLD MOBILE App
- Reproduce, duplicate or copy material from PUREGOLD MOBILE App
- Redistribute content from PUREGOLD MOBILE App
This Agreement shall begin on the date hereof.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Puregold Price Club does not filter, edit, publish or review Comments prior to their presence on the mobile app. Comments do not reflect the views and opinions of Puregold Price Club,its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, Puregold Price Club shall not be liable for the comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Puregold Price Club reserves the right to monitor all comments and to remove any comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.
You warrant and represent that:
- You are entitled to post the comments on our website and have all necessary licenses and consents to do so;
- The comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;
- The comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy
- The comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
You hereby grant Puregold Price Club a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.
Without prior approval and written permission, you may not create frames around our App Pages that alter in any way the visual presentation or appearance of our Mobile App.
We shall not be held responsible for any content that appears on our Mobile App. You agree to protect and defend us against all claims that is rising on our Mobile App. No link(s) should appear on any Mobile App that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.
Purchase of Products
You agree to comply with any and all the guidelines, notices, operating rules and policies and instructions pertaining to the purchase of Products through the App, as well as any amendments to the aforementioned, issued by the Company (Whether as part of use of the Platform or in relation to the purchase of Products), from time to time. The company reserves the right to revise these guidelines, notices, operating rules and policies and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon publication on the Application.
Products are merchandise indicated on the webpage listing and are sold by the Company. Products sold are to be governed by an agreement entered into directly and only between the Company and you.
We also ensure strict compliance with applicable minimum age selling restrictions under the Tobacco Regulation Act of 2003 that prohibit among others the sale or distribution of tobacco products to any minor (below 18 years old). In case of any doubt as to the age of customer, we shall verify the customer’s government issued ID, and refuse to sell such products if the customer is below 18 years old.
The price of the products payable by the Client shall be the Listing Price at the time at which the Order placed by the Client is transmitted to PUREGOLD MOBILE App. All listing prices of the product are inclusive of applicable taxes. PUREGOLD MOBILE App reserves the right to amend the Listing Prices any time without giving any reason or prior notice.
As we try and ensure that all details, descriptions and prices which appear in the App are accurate, errors may occur. Once, we identify an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Concierge and Delivery fees are to be charged on top of the purchased products; such additional charges are clearly displayed where applicable and included in the total transaction amount.
You may place an Order by completing the Order form in the App and clicking the “Place Order” button. PUREGOLD MOBILE App will not accept Orders placed in any other manner. The Client shall be responsible for ensuring the accuracy of the Order.
Upon placing an order, an order number and a confirmation message shall be generated which are available and sent to your App and registered email address, respectively. The email shall constitute acceptance of your Order and an agreement between Parties shall be formed.
We shall provide a valid receipt to the Client upon delivery or pick-up of the purchased products. Also, an electronic receipt shall be generated once the Client selects Card or other online payment. If there is a dispute on the amount indicated in the receipt, Client shall pay the amount indicated in the Order form in the App.
You may pay the product using any of the payment methods prescribed by PUREGOLD MOBILE App. The payment methods may be subject to additional terms as prescribed by PUREGOLD MOBILE App from time to time.
If the customer fails to make any payment pursuant to the terms and conditions of the payment method elected or payment is cancelled for any reason whatsoever, then without prejudice to any other right or remedy available to the Company. The Company shall be entitled to cancel the order or suspend delivery of the products until payment is made in full.
PUREGOLD MOBILE, may stop any products in transit, suspend further deliveries to the Client and/or terminate the agreement with immediate effect by written notice to the Client on or at any time after the occurrence that the product is unavailable, or customer is being in breach of an obligation under the customer contract.
Refund of Payment
All refunds are conditional upon our acceptance of a valid return of the Product.
All refunds shall be made via the original payment mechanism and to the person who made the original payment except for Cash on Delivery, where refunds will be made via bank transfer provided that complete and accurate bank account details are provided to us or via cash pick-up on the defined Puregold store.
We offer no guarantee of any nature for the timeliness of the refunds reaching your account. The processing of payment may take time and it is subject to the respective banks and/or payment provider internal processing timeline.
Delivery of Products
Delivery of the Products shall be made to the Shipping Address the Client specifies in the Order by PUREGOLD MOBILE through our selected courier. You may track the status of the delivery in the App.
All delivery timeframes given are estimates only. In the event of a delay, we will inform you accordingly via e-mail and your Order shall be dispatched as soon as it becomes available. Time for delivery shall not be of the essence of the contract.
In addition, we will require to perform age verification on delivery or at collection of Tobacco product. We shall check the official government issued ID, or equivalent, of the person to whom we are giving the tobacco product to ensure that:
- the ID belongs to that person;
- that person has the same name as the person identified as the recipient of the tobacco products; and
- that person is an adult.
If the consumer cannot be identified and age verified on delivery, Puregold will not leave the tobacco product or deliver them to anyone else.
All returns must be done in accordance with the instructions set here. The Company is not obliged to agree to any return unless all instructions are followed to PUREGOLD MOBILE’s satisfaction. Return of products can only be approved based on the following reasons:
- wrong item is delivered – in original packaging, item is complete with accessories, if any, not damaged, tags and labels attached
- received a damaged item – tags and labels attached, item is complete with accessories, if any
- received a defective item – not damaged; tags and labels attached, item is complete with accessories, if any
- received a product that is not advertised on the website – unused condition, tags and labels attached, not damaged, complete with accessories, if any
- received a product that has missing parts/items – not damaged, tags and labels attached
- received a product that does not fit (for fashion items) except for undergarment – unused condition, original packaging, not damaged, tags and labels attached, complete with accessories, if any
Should the Company agree to the return, the products must be shipped back to the specified store and the Company will deliver the replacement product to the specified address.
It is the responsibility of the Client to notify the Company in writing the return of the product with corresponding reason/s. The Company may initially verify and ask further inquiries on the actual item received through call or e-mail based on the reason for return.
In the event that the customer refuses to take possession of the product or return the item without sufficient cause or justification, the Company will safe keep the item (for non-perishable goods) for a period of seven (7) days from the date the Company receives the product. After the lapse of such period and no confirmation was received from Client, the product is deemed abandoned by the customer. No refunds shall be offered and the Company will provide disposition on the item. For perishable goods, immediate disposition shall be provided.
